If the charges are dropped after the defendant was bailed out, is the premium paid to the bail agent returned?
Usually not. If the charges were not dropped at the time the arrest, the defendant would remain in custody until their court appearance at which time the charges were dropped. The bail bondsman does not make a judgement or determination of the alleged charges at the time of arrest. The bondsman is merely providing the service of obtaining the defendant’s release from custody, thus allowing the defendant to return home and work without interruption in their lives while awaiting trial. The premium paid is the fee to the bail agency for providing that service.
