What is Bail?
Briefly explained, in preparation for a person’s day in court, bail is the portion of our legal system that grants a person that is accused of a crime temporary release so that they may continue to the live their daily lives and prepare for their day in court. In criminal proceedings, it is the sum of money, collateral (property or items of value) and/or bail bond that is posted on behalf of the criminally charged individual to guarantee that they will appear in court. The Eighth Amendment of the Constitution of the United Sated guarantees individuals the right to a reasonable and fair bail.
Legislatures may also set out certain crimes to be not bailable, such as those that carry the penalty of capital punishment. Even for lesser crimes, bail will not be granted if it is deemed likely that the accused will flee, tamper with evidence, or commit the same offense before trial. Bail amounts may vary depending on the type and severity of crime the suspect is accused of; practices for determining bail amounts vary. (Sited)
